These terms bind the practice that uses DoctoNova and the publisher of the service, named at the bottom of this page (“we”). Creating a practice in DoctoNova means accepting them, together with the privacy policy.
1. The service
DoctoNova is online software for running a medical practice: waiting room, patient records, consultations, prescriptions and other documents, appointments, payments. It runs in a browser, with nothing to install.
2. Who can create a practice
The service is meant for doctors and health professionals who are authorised to practise. By creating a practice, you declare that you are one, and you give accurate information about yourself and your practice.
The person who creates the practice is its administrator. They invite their colleagues, choose their roles, and answer for the use those colleagues make of the service.
3. Your account
Each person has their own account. Your password is personal: do not share it, and tell us without delay if you think someone else has used it.
Your email address must stay valid: confirmation links and forgotten-password links are sent to it.
4. Availability and changes
We do what is needed to keep the service available and safe, but we cannot guarantee that it will never be interrupted: maintenance, a failure or a loss of your connection can make it unavailable for a while.
An encrypted copy of your records is made every night with a second hosting provider.
The service changes over time: features are added, improved, and sometimes removed.
5. Plans and price
DoctoNova comes in two plans.
The Free plan is for a doctor who works alone: one account, the doctor’s, open on one device at a time. It includes what the doctor does with a patient: patient records, consultations, prescriptions, lab and imaging orders, certificates, follow-up curves, the child health booklet, a simple queue and payment collected at the end of the consultation. The number of patients and consultations is not limited. It is free as long as the practice is used.
The Pro plan adds what runs the practice: accounts for the front desk, the accountant and other doctors, tickets and the waiting room screen, the agenda and appointment reminders, the list of patients to see again, the closing of the cash desk and the receipts register, the dashboard of the last weeks. It is taken per doctor, for a period of six months or a year paid in advance. Accounts for the front desk and the accountant are included, as many as needed.
Trial. Every new practice tries the Pro plan for 30 days, without paying anything or giving a means of payment.
Price. The price of the Pro plan is the one on the “Pricing” page of the site on the day you agree. The paid Pro plan applies to your practice only after you expressly agree: you are not asked for any payment without that agreement. The price paid holds for the whole period paid. A paid period is not refunded: the trial is there to judge before paying.
End of the trial or of the paid period. The application tells you when the trial or the period ends. A paid period stays open for 30 days after its last day, time to renew it. After that, the practice goes back to the Free plan. Nothing is deleted: you go on working in your records, the other accounts of the practice are put on hold and open again with the Pro plan, the agenda and the cash desk can still be read.
A practice nobody uses any more. No practice is closed for inactivity without its administrator having been told by email, at the address of their account. A practice in which no real patient was ever recorded may be closed after 3 months without a sign-in. A practice that holds records is not closed before 24 months without a sign-in.
6. Your responsibility as a doctor
DoctoNova is a management tool. It does not make diagnoses and does not give medical advice.
You remain solely responsible for your decisions, your prescriptions and the documents you sign. The aids in the software (suggested dosages, templates, favourites, charts, calculations, reminders) are there to save you time: they replace neither your judgement nor your review. Check every prescription and every document before handing it to the patient.
7. Your patients’ data
Your patients’ records belong to you. You are their data controller, within the meaning of Algerian law no. 18-07 of 10 June 2018. We host them on your behalf, as a processor; as a French company, we are subject for this to the European General Data Protection Regulation (GDPR).
In that capacity, we:
- process this data only to provide the service to you, on your instructions;
- do not sell it, rent it or use it for any other purpose;
- access it only if you ask us to in order to help you, or if the security or maintenance of the service requires it, and only through people bound by confidentiality;
- protect it as described in the privacy policy, and tell you without undue delay if an incident affects it;
- entrust it only to the hosting and backup providers described in the privacy policy;
- help you answer your patients’ requests about their data.
For your part, it is up to you to inform your patients, to respect medical confidentiality, and to complete the formalities the law requires with the National Authority for the Protection of Personal Data (ANPDP). The data is hosted in France, and therefore outside Algeria: the privacy policy gives the details.
8. Retrieving your data, closing your practice
You can stop using the service at any time.
The administrator of the practice can ask, at the contact address, for a copy of the practice’s data in a common format, and then for the practice to be closed.
When a practice is closed, its data is deleted from our servers; it disappears from our backup copies no later than 12 months afterwards. You remain bound to keep medical records for as long as the law requires of you: retrieve your data before closing.
9. Use of the service
You agree not to use the service for illegal purposes, not to try to access another practice’s data, not to disrupt its operation, and not to resell it or make it available to anyone outside your practice.
In the event of a serious breach, we may suspend an account or a practice. We tell you beforehand, unless the security of the service or of the data requires immediate action. A suspension does not deprive you of the right to retrieve your data.
10. Intellectual property
The software, its brand and its content belong to us. We grant you the right to use it for the needs of your practice, for as long as you use it; this right is neither exclusive nor transferable.
What you enter in the service remains yours.
11. Liability
We are bound to bring to the service the care that can be expected of a professional. Within the limits allowed by law, our liability covers direct and foreseeable damage caused by a failure on our part. It does not cover the consequences of a use of the service contrary to these terms, of a failure of your equipment or your connection, or of force majeure.
12. Changes to these terms
We may change these terms. You are told by email or in the application before they take effect; the date of the text is shown at the top of this page. If you refuse the new terms, you can close your practice and retrieve your data.
13. Language, governing law and disputes
These terms are written in French. Their translations are given for information: if they differ, the French text prevails.
They are governed by French law. This choice does not release your practice from the rules that bind it in Algeria, in particular law no. 18-07.
In the event of a disagreement, write to us first: we will look for an amicable solution. Failing that, the dispute is brought before the competent courts of the place of our registered office.
